Competition law

PrintMailRate-it

Our advice on competition law is addressed to enterprises which plan transactions that may distort competition or include provisions contrary to the competition law. This means especially mergers, share purchases and other forms of concentration of parties showing a certain high level of turnover, as well as various types of contract or agreement templates that may include provisions prohibited by competition and consumer protection legislation.

The protection of competition grew in importance the moment Poland joined the European Union.  This has been evident from the increased activity of the European Commission and the domestic Office for Competition and Consumer Protection (OCCP) in this area. Nowadays, most undertakings and investment projects need to be checked for compliance with competition law. Sometimes, a transaction has to be notified to the OCCP.

In providing comprehensive services for its clients, Rödl & Partner's experts strive to get to know the nature and specificity of their business as much as possible. With such knowledge and their own extensive experience our law firm’s attorneys at law are able to identify and efficiently deal with problems in the competition law area that may arise in day-to-day business of our clients and in planning larger undertakings.

What we do in the competition law area:

  • check your transactions for compliance with competition law;
  • prepare documents required to report an intended concentration to the OCCP;
  • draft and review contract forms, general terms and conditions etc. for compliance with competition law;
  • represent you in dealings with the consumer ombudsman;
  • represent you in dealings with the President of the Office of Competition and Consumer Protection;
  • represent you before courts, especially the Competition and Consumer Protection Tribunal.
