Extended deadlines for RES producers

14 June 2022

The Polish president signed the Act amending the Environmental Act and certain other acts on 13 June 2022.

RES producers, who had signed connection agreements before the RES Act came into force (i.e. before 4 May 2015), are given time until 16 July 2024 to feed energy into the grid for the first time. As a consequence, non-terminated connection agreements signed before that date will remain in force. All that RES producers have to do is to submit relevant applications to their distribution or transmission operator.

While working on that statute the lawmakers explained that the deadlines would be extended because of the COVID-19 pandemic and the armed conflict in Ukraine which are delaying project implementations. This in turn may prompt power companies to terminate connection agreements. In order to prevent it and to give investors extra time to connect to the grid, they have decided to extend the deadline by two years.

The statute will come into effect 14 days after promulgation in the Polish Journal of Laws.
