State aid to energy-intensive sectors

The Council of Ministers has adopted a programme "Aid to energy-intensive sectors related to sudden increases in natural gas and electricity prices in 2022".

Its aim is to support energy-intensive enterprises in connection with the 2022 electricity and natural gas price increases. The aid will allow enterprises to maintain liquidity, profitability, jobs and production capacity during the crisis. 

Beneficiaries


Enterprises operating in Poland that meet the following two conditions can benefit from the programme:

  • the cost of purchasing electricity and natural gas accounted for at least 3% of their production value in 2021 or 6% of their production value in the first half of 2022,
  • at least half of their revenue or production value came from activities described by PKD codes or PRODCOM codes, listed in the European Commission's list of sectors particularly affected by the effects of the crisis.

Importantly, the aid is not limited to the micro, small and medium-sized business sector only.

Aid intensity


The programme's budget is more than 5 billion Polish zloty. The aid intensity will depend on the amount of eligible costs incurred by the enterprise between February and December 2022.

There will be two maximum aid limits depending on the enterprise's financial standing:

  1. The basic limit will be up to 50% of eligible costs, with a maximum of 4 million euro per corporate group or non-group entity. 
  2. The increased aid limit will apply to enterprises that have experienced a decrease in EBITDA of at least 40% between the whole of 2021 and 2022, or those with a negative EBITDA. The aid amount covered by the increased limit can be up to 80% of eligible costs, up to as much as 50 million euro per corporate group.

Applications for state aid


As announced, the call for applications should start still in January. Enterprises will have 14 days to apply from the date of announcement of the call for applications. The funds under the aid programme will most probably be paid out in February.
