Whistleblowers – the bill may become law as early as the first quarter of 2024

A new whistleblower protection bill intended to implement the Whistleblowing Directive (2019/1937) has appeared on the website of the Government Legislation Centre.

The current version of the bill prepared by the Ministry of Family, Labour and Social Policy is based on the draft bill prepared by the previous government. At the same time, a fast-track procedure has been adopted in view of the penalties threatening Poland for delaying the implementation of the directive. The Council of Ministers is expected to adopt the bill still in the first quarter of 2024.

Key changes in the new bill include:

rejecting the provision saying that reporting persons are protected by law provided that their reports or public disclosures concern the public interest,
changing the rules of liability for false reporting,
longer vacatio legis – the law would become effective 1 month of its promulgation,
the obligation for legal entities to install a whistleblowing procedure within 1 month of the effective date of the law.

Please remember that the obligation to have a whistleblowing procedure applies, among others, to all legal entities for which at least 50 people perform or provide work.
