On 1 July 2024, enterprises will see an invoicing revolution – the National e-Invoicing System (in Polish: KSeF) will come into effect. The President has just signed the act making e-invoicing mandatory.

Who is it for?

The NeIS is for both VAT-registered taxpayers and entities exempt from VAT because of their status. VAT-registered taxpayers will need to be ready to comply with the new obligations from 1 July 2024. Taxpayers exempt from VAT because of their status will get a bit more time – they will be required to issue e-invoices from 1 January 2025.

The NeIS will be mandatory for both entities established in Poland and foreign entities having a fixed establishment here if that establishment is involved in the supply of goods or services.

Invoices for consumers (B2C) and invoices issued by taxpayers using certain special procedures will be excluded.

The act stipulates financial penalties for enterprises which do not use the system.

Challenges and obligations

The NeIS changes the way invoices are issued and received, which will pose a number of challenges for businesses, mainly in connection with adapting their finance and accounting software to the new laws.

There are still 11 months left until the new obligations are binding. Considering the amount of work involved and the commitment of many teams, it is worth preparing in advance for the upcoming changes to avoid possible mistakes in the future.
