The Whistleblower Protection Bill passed by the Sejm

The Sejm passed the Whistleblower Protection Bill on 23 May 2024. It aims to implement a directive of the European Parliament and the EU Council. The legislation should have been transposed by EU countries by 17 December 2021.
 
The bill has been amended a number of times in the course of the legislative process. Ultimately, the statute includes several important elements from the perspective of whistleblower protection that were not mentioned in some previous versions of the bill:

  • the institution responsible for providing support to whistleblowers and receiving external reports will be the Ombudsman,
  • among the breaches of law that may be reported by whistleblowers are breaches of labour law,
  • the statute allows an internal reporting procedure to be shared within a group of companies (provided that it complies with the Polish law),
  • the statute will come into effect 3 months after its promulgation in the Journal of Laws.
 
The bill is now in the Senate and, once passed by the Senate, it will be sent to the President for signature.
