E-inbox obligation postponed

Due to COVID-19 restrictions and insufficient technical preparation for the implementation of the planned solutions, the legislator has postponed the initial deadline for introducing electronic inboxes by, among others, entities entered in the National Court Register (KRS).
 

Obligations and deadlines under the Act on Electronic Service of Documents


The Act on Electronic Service of Documents requires commercial companies to have an electronic mailbox and stipulates when an e-mail is to be considered served.
 
According to the amended provisions, the Act on Electronic Service of Documents will start to apply as follows:

  • the act is scheduled to enter into force on 5 October 2021;
  • entities entered in the register of enterprises of KRS will be obliged to have an address for electronic service starting from 5 July 2022.

 

Obtaining an address for electronic service


Enterprises can apply for an address for electronic service starting from 5 October 2021. In view of the expected duration of the procedure described in the act and severe consequences that you may face if you fail to comply with your obligations, we recommend that you initiate steps to set up an e-inbox as soon as possible.
