New Whistleblower Bill – fast-track procedure

A brand new whistleblower protection bill intended to implement the Whistleblowing Directive (2019/1937) has appeared on the website of the Government Legislation Centre.

The lawmakers have decided to fast-track the legislation, i.e. without consulting the public. This means that the bill may become law very soon.

The new version of the bill prepared by the Ministry of Family, Labour and Social Policy is based on previous drafts. However, the Ministry has reacted to some of the comments made on the previous drafts, that is:

the nomenclature has been amended and the concept of a whistleblower has been introduced,
the scope of the bill has been expanded to include reports on violations of human and civil liberties and rights, corruption, human trafficking, labour law,
anonymous reporting is now explicitly allowed,
the minimum amount of compensation for a whistleblower who has been retaliated against has been set,
it has been specified how to calculate the threshold of 50 workers (in terms of internal whistleblowing),
the vacatio legis is now longer (3 months).

The obligation to implement an internal whistleblowing procedure applies, among others, to all legal entities for which, as of 1 January or 1 July of a given year, at least 50 people perform or provide paid work.
