e-Deliveries - deadline for setting up an electronic inbox

The e-Deliveries Act of 18 November 2020 has changed the way that commercial companies communicate with public administration authorities and courts.  That statute requires, among others, commercial companies to use e-Deliveries and stipulates when an e-mail is to be considered served.

e-Deliveries allow electronic sending and receiving of correspondence with the same effect as registered mail with return receipt.

Who does it apply to?

The new obligations apply to, among others, non-public organisations entered in the National Court Register. These include:
  • limited partnerships,
  • limited liability companies,
  • joint-stock companies.

Deadlines

The official communication from the Ministry of Digital Affairs sets the following implementation deadlines:
  • 10 December 2023 – all new non-public organisations entered in the National Court Register,
  • 10 March 2024 – all non-public organisations entered in the National Court Register before 10 December 2023 have to take the necessary steps.

What to do?

The above-mentioned organisations need to:
  • create inboxes for e-Deliveries,
  • appoint an inbox administrator who will be authorised to activate the inbox address and manage the inbox.
 
E-mail addresses of obliged entities will be disclosed in a public e-mail address database. Service of official correspondence from public administration authorities and courts to the registered inbox will be treated as equivalent to service by post.
 
Steps to register an inbox for e-deliveries should be taken well in advance to meet the deadlines.
