The General Product Safety Regulation (GPSR)1 enters into force on 13 December 2024.

The Regulation mainly aims at enhancing consumer protection and improving the functioning of the EU internal market.

Which products are affected by GPSR?

GPSR applies to products marketed in the EU, whether new or second-hand, repaired or reconditioned. It applies to products offered through all sales channels, including online. However, GPSR does not apply to products such as medicinal products, food, feed, aircraft, antiques.

Product safety

GSPR requires that all products placed on the market in the EU must be safe. Product safety assessment must be carried out based on the following criteria:

  • appearance of the product – the product must be labelled so that it can be easily identified,
  • product characteristics – including physical, mechanical and chemical characteristics of the product,
  • product presentation – the product must not be misleading as to its purpose and use,
  • impact on other products,
  • cybersecurity.

GPSR – new obligations

The Regulation imposes new obligations on traders across the supply chain, including manufacturers, distributors, importers, among others. New obligations for such entities include among others:

  • ensuring that the product conforms with the general safety requirements,
  • reporting of product-related accidents,
  • making their contact details available on the product,
  • immediately informing consumers and the authorities, via the Safety Business Gateway portal, if there is a suspicion that a product placed on the market is dangerous.
