Ensuring access to websites and products – obligation for enterprises

The Polish President signed into law on 9 May the act on ensuring compliance with the accessibility requirements for certain products and services by businesses.

The act implements Directive (EU) 2019/882 of the European Parliament and of the Council on the accessibility requirements for products and services (European Accessibility Act).

The legislation forces adjustments of the following products and services to the needs of people with disability and people with special needs:

desktops, notebooks, smartphones, tablets, e-readers,
automated teller machines, ticketing machines, check-in machines,
telecommunication services,
access to audiovisual media services,
websites for passenger transport services, electronic tickets and electronic ticketing services, delivery of transport service information, including real-time travel information,
consumer banking services,
circulation of e-books,
e-commerce services defined as a service offered or provided at a distance, through websites and mobile devices, by electronic means and at the individual request of a consumer, with a view to concluding a consumer contract.

The new obligations are binding on manufacturers, authorised representatives, importers, distributors and service providers.

Consumers will have the right to complain to the business operator about non-compliance with the accessibility requirements. Moreover, business operators that fail to comply with the statutory requirements will be exposed to administrative penalties up to ten times the average wage.

The act should generally become effective on 28 June 2025.
