Legislative work on the bill to enable employers to check the vaccination status of their employees or customers is still at the stage of evaluation and further review despite the announcement from the Ministry of Health that it will submit the bill to the lower chamber of the Polish parliament (Sejm) in early September.

According to the bill, the employer would be entitled to change the job or workplace of employees who are not vaccinated, have never been infected or hold a valid certificate showing that they are infected with SARS-CoV-2. Such employees might be assigned tasks that do not involve direct contact with other people (e.g. customer service). The bill envisages that the employer could post non-vaccinated employees outside their regular place of work, give them another job for a remuneration appropriate for that job or grant them unpaid leave.

The new proposals for verification of vaccination status not only relate to employees but also to students, in particular medical students.

The planned changes to the COVID-Act are still being clarified and evaluated. It is difficult to foresee the course and timing of further legislative work as well as final decisions to be taken by the government in connection with the proposed changes.
